Terms and Conditions

Last updated: 15 October 2026

These Terms and Conditions govern the use of e-meniu.ro and the purchase of digital products offered through the website.

Please read these Terms and Conditions before placing an order. By completing an order and expressly accepting these Terms and Conditions, you confirm that you have read and understood the provisions applicable to your purchase.

1. Identity of the trader

The website e-meniu.ro is operated by:

  • Telephone: +40 753 662 614
  • Website: https://e-meniu.ro

Throughout this document, the company may be referred to as “e-meniu”, “we” or “the trader”.

2. Scope

These Terms and Conditions apply to the use of e-meniu.ro and to distance contracts concluded for the purchase of digital products available on the website.

Information specific to each product, including its name, content, main characteristics, available versions and price, is presented on the relevant product page and made available to the customer before placing an order.

If a general provision of these Terms and Conditions conflicts with a specific condition clearly communicated for a particular product before purchase, the specific condition shall apply to that product, to the extent permitted by law.

3. Products offered

e-meniu sells digital products in the field of food and nutrition, primarily meal plans and related educational or practical materials.

Products may be available in different versions, including Basic and Premium. The content of each version is described on the relevant product page so that customers can identify the materials included before making a purchase.

Products are supplied electronically, generally in PDF format, and do not involve the delivery of physical goods.

Purchasing a product grants the customer the right to use the material for personal purposes, subject to these Terms and Conditions. Intellectual property rights in the content are not transferred through the sale.

4. Nature of meal plans and customer responsibility

Unless expressly stated otherwise in the product description, the meal plans sold on e-meniu.ro are predefined nutritional materials designed for specific goals, preferences or dietary circumstances.

These materials are intended for educational and practical use. Purchasing a meal plan does not, in itself, constitute:

  • a medical consultation;
  • a medical diagnosis or treatment;
  • an individual health assessment;
  • a personalised dietetic consultation;
  • personalised medical advice.

Customers should review the product description and assess whether the selected material is appropriate for their needs and circumstances.

People with medical conditions, food allergies or intolerances, those taking medication, pregnant or breastfeeding individuals, and anyone whose circumstances require personalised nutritional advice are encouraged to consult a doctor and/or a qualified nutrition and dietetics professional before using the plan.

Customers are responsible for identifying ingredients and allergens that may be unsuitable for their individual circumstances and for seeking professional assessment when necessary.

Results obtained from following a meal plan may vary depending on individual characteristics, health status, physical activity, consistency of implementation and other factors.

e-meniu does not guarantee any specific result concerning weight, body composition or health status.

Nothing in this section excludes or restricts statutory consumer rights or any liability that cannot legally be limited.

5. Placing an order and formation of the contract

To purchase a product, the customer selects the desired product and version, follows the steps displayed in the online store, provides the requested information and completes payment using one of the available payment methods.

Creating a user account is not mandatory to place an order where guest checkout is available.

Before completing an order, customers can review the information provided, the selected products and the total amount payable.

By submitting an order, the customer confirms that the information provided is accurate and that they accept the applicable Terms and Conditions.

Placing an order entails an obligation to pay.

Once an order has been submitted and accepted, the customer receives confirmation by email through the website’s order processing and communication systems.

The distance contract is concluded in accordance with applicable law when the trader confirms acceptance of the customer’s order on a durable medium.

6. Prices, currencies and payment methods

The price applicable to a product is the price displayed on the website when the order is placed.

On the Romanian-language version of the website, prices are displayed and processed in Romanian lei (RON). On the English-language version, prices are displayed and processed in euro (EUR), in accordance with the store’s commercial configuration.

Prices displayed to consumers are final prices and include VAT at the rate applicable to the transaction. The total amount payable is presented before the order is completed.

Payment is made using the methods available during checkout, including payment by bank card and, where supported by the customer’s device or browser, Apple Pay and Google Pay.

Electronic payments are processed through specialised payment service providers, such as Stripe.

e-meniu does not ask customers to submit their full payment card details by email or through the website’s standard forms.

Where the card issuer or payment service provider applies its own currency conversion rate or fees, these are determined by the relevant financial institution rather than e-meniu.

7. Promotional codes, discounts and benefits

e-meniu may offer promotional codes, discounts or other commercial benefits.

Each promotion is subject to the conditions communicated when the offer is made available.

These conditions may include the validity period, eligible products, discount value, rules of use or whether the offer can be combined with other promotions.

Promotional codes cannot be exchanged for cash unless expressly permitted by law or the terms of the relevant promotion.

Receiving a promotional benefit does not automatically entitle the customer to the same discount on future purchases.

8. Supply of digital products

Purchased products are supplied electronically through the delivery mechanisms available in the online store.

Depending on the circumstances, access to a product may be provided through:

  • the order confirmation page;
  • links included in emails sent to the customer;
  • the section dedicated to purchased products in the customer’s account, where an account exists;
  • other digital delivery methods expressly communicated for the relevant product.

As a general rule, the product becomes available after payment has been confirmed and the order has been processed, without undue delay.

The obligation to supply the digital product is fulfilled when the product, or an appropriate means of accessing or downloading it, becomes available to the customer in accordance with applicable law.

Customers must provide an accurate email address and should also check their Spam, Promotions or other folders where automated messages may be delivered.

If a purchased product cannot be accessed or a technical delivery problem occurs, customers may request assistance at contact@e-meniu.ro.

9. Technical requirements and use of files

To access and use digital products, customers need:

  • a compatible device, such as a computer, smartphone or tablet;
  • an internet connection to obtain the purchased product;
  • software capable of opening the format in which the material is supplied, generally PDF.

We recommend saving a copy of the purchased product on your own device so that it can also be consulted without an internet connection.

Unless expressly stated otherwise on the relevant product page, purchasing a predefined meal plan does not include individual consulting services, a subscription or the automatic provision of future editorial editions.

This provision does not affect the trader’s statutory obligations to provide updates necessary to maintain the conformity of digital content where required by applicable law.

10. Right of withdrawal for digital products

Under Romanian Government Emergency Ordinance No. 34/2014 (OUG No. 34/2014), consumers generally have a statutory right to withdraw from a distance contract within 14 days, subject to the exceptions established by law.

For contracts concerning digital content not supplied on a tangible medium, the law provides a specific exception to the right of withdrawal.

This exception applies only where all the relevant legal conditions have been met, including:

  1. The consumer has given their prior express consent for the supply of digital content to begin during the withdrawal period.
  2. The consumer has acknowledged that, by allowing supply to begin under these conditions, they will lose their right of withdrawal.
  3. The trader has provided confirmation of the contract, including confirmation of the consumer’s consent and acknowledgement, on a durable medium as required by law.

During checkout, customers purchasing digital products intended for immediate supply are asked to provide the relevant express consent and acknowledge the consequences for their statutory right of withdrawal.

Where all legal conditions are satisfied and the supply of digital content has begun, the consumer loses the right to withdraw solely because they have changed their mind.

If the legal conditions for losing the right of withdrawal have not been met, the consumer retains the withdrawal rights provided by applicable law.

This exception does not affect the consumer’s rights where a product has not been supplied, is not in conformity or where other circumstances give rise to statutory remedies.

11. Refunds and repayment

Given the nature of digital products, e-meniu does not provide voluntary refunds solely because a customer changes their mind after supply has begun, where the statutory right of withdrawal has been lost in accordance with the law.

This policy does not exclude refunds or other statutory remedies in circumstances such as:

  • the digital product has not been supplied;
  • the product received does not correspond to the product ordered;
  • the product is not in conformity with the contract;
  • payment has been collected incorrectly;
  • the consumer validly exercises a statutory right of withdrawal;
  • other circumstances in which applicable law provides a right to a remedy, price reduction, termination of the contract or repayment.

Requests are assessed according to the circumstances of each case and the applicable legal provisions.

Where a refund is legally due, it will be made within the time limits and using the methods required by applicable law.

Customers may submit refund-related enquiries to contact@e-meniu.ro, providing the information needed to identify the relevant order.

12. Legal guarantee of conformity

Digital products sold on e-meniu.ro are protected by the legislation governing the conformity of digital content, including Romanian Government Emergency Ordinance No. 141/2021 (OUG No. 141/2021).

The digital content supplied must correspond to the description and characteristics communicated before purchase and meet the applicable statutory conformity requirements.

Depending on the product and circumstances, these requirements may concern the actual content, functionality, compatibility, accessibility and other relevant characteristics.

Where digital content is not in conformity, consumers are entitled to the remedies provided by law. Depending on the applicable legal conditions, these may include bringing the product into conformity, a proportionate price reduction or termination of the contract.

Statutory conformity rights are separate from any commercial guarantees and cannot be excluded or restricted by these Terms and Conditions.

13. Delivery problems and product-related complaints

If a customer experiences a problem concerning the supply, accessibility or conformity of a product, they may submit a request to:

contact@e-meniu.ro

To help us identify and resolve the issue, we recommend including:

  • the order number, where available;
  • the email address used for the purchase;
  • the name of the product;
  • a description of the problem;
  • any additional information relevant to assessing the situation.

e-meniu will review the request and provide appropriate assistance or corrective measures in accordance with its obligations and applicable law.

14. Copyright and intellectual property rights

Content available on e-meniu.ro, including texts, meal plans, recipes, educational materials, document layouts, graphic elements, photographs, illustrations and other protected works, is subject to copyright and intellectual property legislation.

The relevant rights belong to their lawful holders.

By purchasing a digital product, the customer receives a personal, non-exclusive and non-transferable right to use the material for their own purposes.

Except where permitted by law or expressly authorised by the rights holder, the following activities are prohibited:

  • reselling the digital product;
  • distributing all or part of the material to other people;
  • publishing or making the material available to the public;
  • uploading the material to public platforms, groups, websites or file-sharing services;
  • reproducing or exploiting the material for commercial purposes;
  • presenting or marketing the material as the customer’s own work;
  • removing elements identifying the author or rights holder without authorisation.

Purchasing a product does not transfer copyright or other intellectual property rights to the customer.

15. Unauthorised use of materials

e-meniu digital products are intended for personal use, in accordance with the rights granted at the time of purchase.

Unauthorised distribution, publication, resale or exploitation of these materials may constitute an infringement of intellectual property rights.

Where such circumstances are identified, e-meniu reserves the right to pursue the legal remedies available to protect the materials and the legitimate interests of the relevant rights holders.

Any measures taken will comply with applicable law and will not prejudice consumers’ statutory rights.

16. Website availability and operation

e-meniu makes reasonable efforts to maintain the operation of the website and its ordering, payment and digital delivery systems.

Temporary interruptions may occur due to maintenance, technical updates, infrastructure failures, problems affecting external service providers or other circumstances that interfere with online services.

Such circumstances do not remove the trader’s statutory obligations or affect rights already acquired by consumers in relation to purchased products.

Customers experiencing problems accessing a purchased product may request assistance using the contact details provided on the website.

17. User accounts

The website may allow customers to create an account to manage orders and access features available to registered users.

Customers who choose to create an account are responsible for maintaining the confidentiality of their login credentials and using their account appropriately.

Customers should inform e-meniu if they suspect unauthorised access to their account.

e-meniu may take reasonable and lawful measures necessary to protect account security and user information.

Creating an account is not a condition for purchasing products where the online store allows orders to be placed without registration.

18. Electronic communications

e-meniu uses electronic communications, primarily email, to process and fulfil orders.

These communications may include:

  • order confirmations;
  • payment information;
  • commercial or tax documents, where applicable;
  • information necessary to access purchased products;
  • notifications relevant to the performance of the contract;
  • responses to customer enquiries.

Communications necessary for performing the contract are separate from commercial and promotional messages.

Subscription to the newsletter is optional and takes place separately, in accordance with the rules governing commercial communications.

Purchasing a product does not automatically subscribe the customer to the newsletter.

19. Personal data protection and cookies

Personal data is processed in accordance with applicable legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR).

Information about the categories of personal data processed, purposes, legal bases, recipients, retention periods and data subject rights is available in the Privacy Policy published on the website.

The use of cookies and similar technologies is explained in the Cookie Policy.

Where consent is required by law, users can provide or change their choices through the cookie preference management mechanism available on the website.

These Terms and Conditions do not replace the Privacy Policy or Cookie Policy.

20. Complaints and customer support

For questions, requests or complaints relating to products, orders, payments or the supply of digital content, customers may contact:

E-MENIU CONCEPT S.R.L.

Email: contact@e-meniu.ro

Telephone: +40 753 662 614

To help us identify an order promptly, we recommend providing the order number and the email address used for the purchase.

e-meniu will review complaints and respond in accordance with applicable legislation, taking into account the nature of the request and the consumer’s rights.

21. Alternative Dispute Resolution (ADR)

If a dispute arises concerning the purchase of a product or the performance of a contract, consumers are encouraged to contact e-meniu first to seek an amicable resolution.

Consumers may, in accordance with applicable law, use Alternative Dispute Resolution (ADR) mechanisms made available by the relevant authorities and competent bodies.

Official information about ADR procedures is available from the Romanian National Authority for Consumer Protection (ANPC):

https://anpc.ro/sal

ANPC’s electronic ADR platform:

https://reclamatiisal.anpc.ro

Using an alternative dispute resolution mechanism does not remove the consumer’s right to contact the competent authorities or bring proceedings before the courts, subject to applicable law.

22. Applicable law and dispute resolution

These Terms and Conditions and contracts concluded through e-meniu.ro are governed by Romanian law.

This choice of law does not deprive consumers of the protection provided by mandatory legal provisions otherwise applicable to them, including relevant European Union consumer protection rules where applicable.

Disputes that cannot be resolved amicably or through an available alternative dispute resolution mechanism will be settled by the courts having jurisdiction under applicable law.

23. Amendments to the Terms and Conditions

e-meniu may amend these Terms and Conditions to reflect legislative changes, updates to products and services or changes in the operation of the online store.

The version applicable to an order is generally the version made available to the customer when the contract was concluded.

Subsequent amendments do not retroactively reduce rights already acquired by the customer or unilaterally alter the conditions of an existing purchase except where permitted by law.

The date of the most recent update is displayed at the beginning of this document.

24. Final provisions

If any provision of these Terms and Conditions is found to be invalid, unenforceable or contrary to a mandatory legal rule, the remaining provisions will continue to apply to the extent permitted by law.

Nothing in these Terms and Conditions is intended to exclude or restrict any consumer right protected by applicable law.
